Limited Liability Indemnity

This page sets out the limits of our liability and your indemnity obligations when you use modernlight.store or buy from Caruso Consulting Co Ltd, trading as Modern Light Company ("we", "us" or "our"). It forms part of our Terms & Conditions.
Your consumer rights come first
Nothing on this page limits or excludes any right you have, or any liability we have, that cannot lawfully be limited or excluded. This includes your rights under the consumer protection and sale of goods laws of your province or territory, and our liability for death or personal injury caused by our negligence, or for fraud.
Some provinces and territories do not allow certain limits or exclusions of liability. Where that is the case, those parts of this page do not apply to you.
Limitation of our liability
Subject to the section above, and to the extent permitted by law:
- We are not liable for any indirect, consequential, special, incidental, punitive or exemplary loss or damage. This includes loss of profit, revenue, data or goodwill, and losses caused by interruptions or delays, however they arise.
- We are not liable for loss or damage that was not reasonably foreseeable.
- We are not liable for loss or damage caused by misuse of a product, by not following its instructions, by installation that does not meet the electrical code that applies where you live, or by normal wear and tear.
- Where we are liable, our total liability to you for any claim is limited to the amount you paid for the products that the claim relates to.
Using our products
Hardwired light fittings must be installed by a licensed electrician in line with the electrical code that applies where you live. Solar and plug-in products can be set up by you, following the instructions that come with them.
To the extent permitted by law, you are responsible for how our products are installed and used, and for any damage to you, your property or other people that results from use that does not follow the instructions or the electrical code. This does not apply to damage caused by a fault in the product, or by our own negligence, wilful misconduct or fraud.
Delivery and availability
To the extent permitted by law, we are not liable for delivery delays caused by events outside our reasonable control, or if a product becomes unavailable. If we cannot supply something you have paid for, we will refund you in full. This does not affect any right you have to cancel an order that is not delivered on time.
Website availability and information
We provide the information on this website in good faith and "as is". We try to keep it accurate and complete, but we do not promise that it always will be. We try to keep the site available and working, but we do not promise uninterrupted or error-free access. We may suspend, withdraw or change all or part of the site without notice.
To the extent permitted by law, we are not responsible for unlawful acts by third parties that we could not reasonably prevent, such as hacking, interception of data, fraud or theft.
This website is intended for customers in Canada. If you do not agree with these terms, please stop using the website.
Your indemnity
To the extent permitted by law, you agree to cover (indemnify us for) any reasonable losses, costs and claims, including reasonable legal fees, that we incur because you broke our Terms & Conditions, misused the website, or infringed another person's rights through your use of the website.
This indemnity does not cover loss caused by our own breach, negligence, wilful misconduct or fraud. It does not limit any right you have under consumer protection law.
