These Terms & Conditions apply when you use modernlight.store and when you buy from us. The website is operated by Caruso Consulting Co Ltd, trading as Modern Light Company ("we", "us" or "our"). By using the website or placing an order, you agree to these terms. Please read them carefully.

Your consumer rights

Nothing in these terms limits any right you have that cannot lawfully be excluded under the consumer protection and sale of goods laws of your province or territory. If any part of these terms conflicts with those laws, the law applies.

Who can use the website

By using this website, you confirm that you are at least 18 years old, or the age of majority in your province or territory if that is higher. If you are younger, please use the website only with a parent or legal guardian.

Use of the Website

We give you a limited, personal licence to use this website for shopping. You may not transfer this licence, and we can withdraw it if you break these terms. When you use the website, you agree that you will not:

• Use it in any way that breaks the law.
• Upload or send anything that contains viruses or other harmful code.
• Post anything that is unlawful, threatening, defamatory, obscene or discriminatory, or that infringes someone else's rights.
• Try to gain unauthorised access to our systems, or interfere with how the website works or its security.
• Copy, sell, modify, reverse-engineer or otherwise exploit the website or its content, or use it for another business, without our written permission.
• Give false information or pretend to be someone else.

If we give you a login for any part of the website, please keep your login details safe. Tell us straight away if you think someone else has used them.

All content on this website, including the Modern Light Company name, logo, product images and text, belongs to us or our licensors and is protected by intellectual property laws. It is for your personal, non-commercial use only.

Products & Descriptions

We take care to describe our products accurately, including materials, sizes and specifications. Product photos are for illustration, and colours and finishes can look slightly different on different screens.

Installation & Electrical Safety

Hardwired light fittings, such as most chandeliers, pendants, ceiling lights, wall lights and vanity lights, must be installed by a licensed electrician in line with the electrical code that applies where you live.

Solar and plug-in products can be set up by you. Please follow the instructions that come with them.

Before you buy and before installation, please check the voltage and other specifications on the product page. If anything is unclear, ask us first.

Pricing

All prices are in Canadian dollars. We work to make sure prices are correct when they are published. If we find a pricing error in an order you have placed, we will contact you before dispatch to ask whether you want to go ahead at the correct price. If you do not, we will cancel the order and refund you in full.

Ordering

Important ordering and delivery information for orders from modernlight.store.

• Order processing. Once your payment has cleared, orders are usually handled within 24 to 48 hours.
• Contacting us. You can email us about your order. We aim to reply within one business day.
• Delivery times. For full details, see our shipping page.

Orders & Purchase Terms

• When you place an order, you are making an offer to buy. A contract is formed when we confirm and dispatch your order.
• We may refuse or cancel an order, for example when stock is not available, when we suspect fraud, or when we believe the order breaks the law or these terms. If we cancel an order you have paid for, we will refund you in full.
• Please give us accurate delivery and contact details. We are not responsible for delays or failed deliveries caused by incorrect details you gave us.

Payment & Security

Payment is taken at checkout through our secure, encrypted payment providers. We do not store your full card details. Your order is processed once payment is approved.

Shipping, Returns & Cancellations

Delivery times, where we deliver, and our full return, refund and cancellation terms are set out on our Shipping and Refunds & Returns pages. Those pages form part of these terms.

Limitation of Liability

To the extent permitted by law:

• Our total liability for any claim connected with an order is limited to the amount you paid for the products that the claim relates to.
• We are not liable for indirect or consequential losses, or for loss of profit, data or opportunity.
• We provide the website "as is" and do not promise it will always be available, uninterrupted or free of errors.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited under the law that applies to you. Some provinces and territories do not allow certain limits on liability, so some of the limits above may not apply to you. Our Limited Liability Indemnity page gives more detail.

Governing Law

These terms are governed by the laws of the province or territory in Canada where you live, and by the federal laws of Canada that apply there. Nothing in these terms stops you from bringing a claim in the courts of your province or territory.

Changes to These Terms

We may change the website and update these terms from time to time. The version published on this page when you place an order is the version that applies to that order.
